Government denied leave to appeal Bashir court order

The government may not appeal the court ruling that it acted unconstitutionally when it did not arrest Sudanese President Omar al-Bashir.

Three judges of the High Court in Pretoria ruled on Wednesday that the Implementation Act did not give heads of state immunity from prosecution on criminal charges.

On June 15, the High Court ordered the government to arrest Bashir when he was in Johannesburg for an African Union summit – but despite the court order, he left the country.

The International Criminal Court had issued a warrant of arrest for Bashir, wanting him to stand trial on charges of war crimes and genocide.
